Terms of sale
The rules for buying from ORSA, written to be read rather than skipped. Where Saudi consumer law gives you more than these terms do, the law applies — we say so in each section rather than hiding it at the end.
Version 1.0 · last updated 20 August 2026 · contact
Draft for legal review. Prepared against the Saudi E-Commerce Law (Royal Decree M/126) and its Implementing Regulations, the Civil Transactions Law, and Ministry of Commerce guidance, and to be reviewed by Saudi counsel before the store takes payment. An Arabic version is required and is being prepared; commercial registration and VAT numbers will be inserted before launch.
Who you are buying from
ORSA, an independent clothing label based in Riyadh, Kingdom of Saudi Arabia, selling at orsaclothing.com. Contact: hello@orsaclothing.com, Sunday to Thursday, 10:00–19:00 AST.
Our commercial registration number, registered address and (once registered) VAT number will appear here and on every invoice before the store takes payment, as Article 6 of the E-Commerce Law requires.
These terms apply to everything sold through the site. By placing an order you accept them. Please read them before you order — they are also linked at checkout, not only in the footer.
How the contract is made
- You place an order. That is an offer to buy, not yet a contract.
- We send an acknowledgement confirming we received it.
- The contract exists when we confirm your order and tell you the ship window. If we cannot supply something, we say so and charge you nothing for it.
- We issue you a storable invoice showing what you bought, the price, the delivery date and place, and a summary of your return rights.
If you made a mistake — wrong size, wrong address — tell us within 24 hours and we will correct it if the order has not shipped. That right comes from Article 4 of the Implementing Regulations.
Our advertising is part of the deal: under Article 10 of the E-Commerce Law an electronic advertisement is a contractual document binding on us. If we advertised it, we will honour it.
Pre-orders
Drop 01 sells on pre-order: you pay when you order, and we ship when the run lands.
- We tell you the ship window before you pay and repeat it on your order confirmation.
- If we expect to be late, we tell you as soon as we expect it — a duty under Article 14(2), and our own standard regardless.
- If we are more than fifteen days past the date we agreed, you may cancel and recover what you paid, plus costs the delay caused you, under Article 14(1) — unless the cause was genuinely beyond our control.
- You may cancel a pre-order at any time before it ships, for a full refund.
- Your 14-day return window starts when the parcel arrives, never when you paid.
Prices and tax
All prices are in Saudi riyals (SAR) and are the price you pay: the amount shown is the amount on your invoice. We charge the same price on the site as anywhere else, all year. We do not inflate prices in order to discount them.
Where value-added tax applies to a sale, the displayed price includes it, and your invoice will show the tax and our VAT registration number. Until ORSA is VAT-registered, prices are shown as the final amount payable and invoices are issued as ordinary commercial invoices rather than tax invoices.
If a price is obviously wrong — a decimal in the wrong place — we may cancel the order and refund you in full rather than hold you to it. We will tell you promptly if that happens.
Payment
We accept mada, Apple Pay, Visa and Mastercard, and instalments through Tabby or Tamara subject to their approval and their own terms.
Payments are processed by a licensed Saudi payment provider. We never see or store your full card number. If a payment fails or is reversed we may cancel the order, and we will tell you.
Choosing Tabby or Tamara creates a separate agreement between you and them. If you later return the goods, we notify them and your plan is cancelled or reduced accordingly.
Delivery
| Where | Everywhere in the Kingdom of Saudi Arabia |
| Riyadh & Jeddah | 1–2 working days from dispatch |
| Elsewhere in the Kingdom | 2–4 working days from dispatch |
| Cost | SAR 25 flat · free on orders over SAR 500 |
We give you the delivery date and place on your invoice, as Article 8 of the E-Commerce Law requires, and a tracking link when the parcel leaves us. Risk in the goods passes to you on delivery.
Please check the parcel on arrival and tell us within 48 hours if it arrived damaged, so we can raise it with the courier. That does not limit your rights over a faulty product.
Returns and refunds
In full on the Returns & refunds page, which forms part of these terms. In summary:
- 14 days from delivery, for any reason, unworn and unwashed with tags attached — we pay the return shipping.
- Your statutory right to cancel within seven days of receipt under Article 13(1) of the E-Commerce Law exists independently and is not reduced by anything here.
- Refunds go back to the payment method you used.
- Exchanges are free, including redelivery.
Faults and warranty
If a piece is faulty, not as described, or not what you ordered, we will replace it or refund it — your choice — and we cover the cost of getting it back to us and the replacement out to you. There is no 14-day limit on a genuine fault.
We do not claim a fixed warranty period on clothing: Saudi rules set minimum warranty terms for vehicles and electrical goods, not apparel. What we do commit to is simple — if a piece fails through a fault in the material or the making, tell us and we will put it right. Fair wear and tear, damage from misuse, and failure to follow the care instructions are not faults.
Product descriptions and imagery
We describe every piece as accurately as we can — fabric, weight, fit, measurements and care. Two honest caveats:
- Colour varies by screen. If a colour is not what you expected, that is exactly what the 14-day return is for.
- Some product imagery is digitally generated rather than photographed, and is reviewed against the actual specification before publication. Where an image and the written specification ever disagree, the written specification governs — and a piece that does not match its written specification is a fault, with all the rights in the section above.
Measurements are given for the stated size and may vary by roughly a centimetre between garments, as is normal in clothing.
Using the site
Please do not attempt to break, overload or gain unauthorised access to the site, scrape it at volume, or use it for anything unlawful. We may refuse or cancel orders where we reasonably suspect fraud or misuse — for instance repeated orders on failing cards, or return abuse. If we do that to you and you think we are wrong, tell us and a person will look at it.
Our content
The ORSA name, the photographs, the writing and the design of this site belong to us. You are welcome to share our pages and images with attribution; please ask before using them commercially.
Liability
We are responsible for delivering what you bought, in the condition described, and for putting it right when we do not. Where we are liable for a failure to perform this contract, our liability is limited to the value of the order concerned — except in cases of fraud, gross negligence, death or personal injury, or anything else that Saudi law does not permit to be limited, where no limit applies.
We do not exclude or limit any liability that the law does not allow us to exclude or limit, and nothing in these terms reduces your statutory rights as a consumer.
We have deliberately not written a blanket "we exclude all liability to the maximum extent permitted by law" clause. Under Article 96 of the Civil Transactions Law a Saudi court may vary unfair terms in a contract of adhesion, and under Article 173 an exemption from liability for fraud or gross negligence is void. A clause we could not enforce would only mislead you.
Events outside our control
We are not liable for delay or failure caused by something genuinely beyond our control — natural events, government action, a courier's network failure, or similar. If that happens we will tell you, and if the delay is substantial you may cancel and be refunded in full.
Privacy
How we handle your personal data is set out in the Privacy policy, which forms part of these terms.
Complaints and disputes
Write to hello@orsaclothing.com or use the contact form. We acknowledge within one working day and aim to resolve within five working days.
If we cannot resolve it, you may raise it with the Ministry of Commerce (Balagh Tijari, 1900, or mc.gov.sa). Coming to us first is not a condition, and neither step prevents you from bringing the matter before the competent Saudi courts, which are the only body able to award compensation.
Governing law and language
These terms and any contract made under them are governed by the laws of the Kingdom of Saudi Arabia, and the competent courts of the Kingdom have jurisdiction over any dispute.
An Arabic version of these terms is being prepared and will be published. Arabic is the official language of the Saudi courts, and where the Arabic and English versions differ, the Arabic version governs.
Changes to these terms
We may update these terms. The version that applies to your order is the one published when you placed it — a later change cannot be applied backwards to a purchase you already made. Each version is dated and numbered at the top of this page.
